Individual Sentenced After Guilty Plea to Unauthorized Access of a Computer U.S. Attorney’s Office April 02, 2009 Northern District of Florida (850) 942-8430 GAINESVILLE, FL—E. Bryan Wilson, Acting United States Attorney for the Northern District of Florida, today announced that Craig Matthew Feigin was sentenced to 30 months’ imprisonment, to be followed by a three-year term of supervised release, and the imposition of multiple special conditions, including strict limitations on internet access and use. Feigin was convicted following a guilty plea to unauthorized access of a computer with the intent to commit a crime, in violation of Title 18, United States Code, Section 1030©(2)(. The offense involved the surreptitious installation and use of malicious spy ware to secretly create and download images of another person. Feigin developed this software and implanted it on the victim’s computer. He also marketed the software on e-Bay and other sites as “Web Cam Spy Hacker.” During the sentencing hearing, the victim described the lasting and permanent effects of having her image placed on the Internet without her knowledge or permission. The sentencing court determined that the crime involved the use of a special skill and sophisticated means. In imposing the thirty-month sentence, which exceeded the advisory sentencing range calculated under the United States Sentencing Guidelines, the Court referred to the victim’s testimony and stated that Feigin’s crime was one that “just keeps on giving.” Mr. Wilson commended the diligent efforts of the Gainesville Police Department and Federal Bureau of Investigation in investigating the case. The case was prosecuted by Assistant United States Attorney Frank Williams.
