Legal question

So I own an BMW clownshoe.

I just found out nice fellow of Enthusiastdriven.com.

They sell lots of M coupe merchandise,

and use for all of them my image without rights.

 

This is my car from my photoshoot. the original image:

Basicly 80% of their all sales come from my art without permissions.

My car has numerous individual mods that are all copied straigt trough as well as not even changing those reflections.

Cheekily they tried to do M coupe by adding 3 minutes worth of strokes in Illustrator.

Sadly they forgot to do M-sidegills too.

These are straight copy from my unique car. Without same car, same lens, same controlled light environment and same location (6metres above car) you cant reproduce that image.

We photoshoot my car that day, I had 2 models and a photographer with me, an unique closed location and we spent shit load of effort to do these photos just for the sake of it.

 

This is a very small problem I know.

But I would like to know how to deal with this.

 

My target is to either make them write down who's copyrighted product they are selling, or giving me a cut of the money.

BUT I am not willing to spend any money to hunt this thing.

 

Any advise? I hope someone could send them a threatening letter or so.

it sucks, unless it's a big company to go after, it's usually not worth it...

 

I was walking through the mall one day and at one of these stands in the middle of the mall I saw car t-shirts hanging, one of them was a 1996 Viper GTS, I walk by and and think, damn, that car has the same wheels as my car, sure enough, it was my car, and the shirts were being sold in malls throughout the country, from a company called Mad Engine.

 

at the time a copyright attorney said it wasn't worth pursuing since I didn't "register" the image, and that I should register all my images with the copyright office so that each infraction is worth $100k....

 

and even if it is a BIG company, you'll still have issues, I had very big company steal one of my videos that I DID register with the copyright office, and even now I can't get an attorney to pursue because the company is TOO BIG!

Same deal like FikseSTS they used photos of my car, nicely modded Mazda RX7, on posters and selling them at Kmart, I was in shock when I saw it, I was actually flattered :icon_mrgreen:

 

I can't remember if I bought a poster, it was about 15 years ago.

Yes imitation is most honest form of flattery.

But there is still a fine line imho when they put their own logo on it.

go anywhere they are posting, and mention the theft. the satisfaction of crapping on their parade costs nothing

The marketing director at the company I work for innocently grabbed a photo off the internet to use on our website.

While he had no ill intentions the company received a letter demanding payment for the use of the photo.

Our company paid and he was warned never to do that again.

 

If you feel that it is worth your time and money contact a lawyer.

Only you can make the decision on if its worth it or not.
